DocuSign Compliance, discloure language, certificates, etc.

Hi, 

Our client is asking for the following items and I can’t seem to find the information easily anywhere in DocuSign. Could someone direct me to the right area by providing a link or answer the questions below?

 

  • Demonstrate compliance with federal ESIGN and UETA disclosure and consent laws:
  • Provide a copy of the mandatory pre-consent disclosure language that will be given to the client via the vendor’s eSign platform.
  • Provide a copy of the client’s affirmative consent, reasonably demonstrating the client’s ability to receive electronic records in the formats that will be used for delivering the required information (e.g., snap shots of vendor’s corresponding eSign steps).
  • Provide examples of output Global Atlantic will receive (e.g., sample eSigned annuity application form) - 
  • Confirm the eSign process utilizes a unique signature identifier or hash function.
  • Provide a sample certificate of completion and audit trail for the eSigned document.
  • All legally mandated components of a valid eSignature must be captured in the certificate of completion and audit trail.
  • The certificate of completion and audit trail must be included with each eSIgned document

Please view my below responses:

  • You may find the needed information in the following article: https://www.docusign.com/products/electronic-signature/legality
  • This can be provided to the client using a previous signed document, if not, the wording can be found in the following article:  Sample Default Legal Disclosure
  • Can you clarify on this? If the legal disclosure is set to be accepted each time a signer views the document for the first time it will always show the consent on the electronic signature at the end of the completed document: Enable the Electronic Record and Signature Disclosure for Your Account , is that what you are looking for? If not, please provide more information.
  • Can you also clarify on this? Is it a specific document you need to add to your documents you send out for signature? Are you looking for a way to integrate?
  • All signatures have a unique identifier that usually shows as a frame on the signature (please keep in mind that you can not trace information with that parcial identifier as it is for support to identify the signature internally): Signature Adoption and Format
  • A sample certificate can be downloaded from any of your previous documents and provided to the client (you can edit it to remove any personal information from the signer of the document the certificate belongs to): Certificate of Completion
  • You can set your account in a way that allows the certificate to always be provided to the client and the Audit trail, which I'm assuming would be the history, is as well always provided when accessing the document via the platform (either via email directly or the Web App) and available to download: Envelope History , Other Signing Actions , Envelope Delivery. Please note that this last article contains the feature that needs to be enable to attach the Certificate of completion to all your completed documents "Attach certificate of completion to envelope", you need an admin to enable this feature on your account. Please note that audit trails can not be attached but is available for all signers to see during the signing session or after completed via the envelopes completed link as shown in the second article.
