I would like to point out that recent cross-border data regulations, as outlined in the new guidelines (https://mp.weixin.qq.com/s/I8bGNv59pXP7KZHf_SuYag,https://mp.weixin.qq.com/s/-Y-dY_HL21jHTFQsMbeiVQ ), provide exemptions under certain conditions.

Specifically, Article 5 states that data processors are exempt from declaring cross-border data security assessments, signing standard contracts for personal data export, or undergoing personal data protection certification when providing personal information overseas under certain conditions. These include situations necessary for fulfilling contracts where the individual is a party, such as cross-border shopping, logistics, remittances, payments, account openings, flight and hotel bookings, visa applications, and examination services.

Given this exemption, the implementation of such certifications should be considered under these conditions. However, it’s important to note that there are also quantitative limits, and a legal assessment will ultimately be necessary.
