Other party renegotiating, but partially executed document is "completed" per Docusign, can the original be voided?

This is a Docusign question, not a legal question.

 

The situation: We negotiated the terms for an residential lease with a realtor. They sent it to us to be signed, which we did. I signed and my wife signed and the document is “completed” per Docusign. The landlord is “an older guy” who doesn’t do stuff online, so the realtor printed our partially executed, Docusign-completed version to get landlord’s signature in ink so it would be fully executed. Fine.

Here’s where it gets complicated: when the realtor brought the partially executed document to the landlord, the landlord tried to renegotiate the terms with us (apparently, we were not negotiating with the landlord, but with the realtor, and the landlord and realtor were not on the same page).

 

The problem: In the end, we were not able to come to an agreement with the landlord, and now there is a partially executed version of this document out there. Since the document is considered “completed” by Docusign, we can’t do a simple “void” (at least I don’t see how to do this).

So we will go on and find a new lease. But there is a possibility that if the landlord is unable to find someone to rent this place, he could finish executing our lease and then we would end up in a situation where we were party to two leases.

 

The question: Can this document be voided or cancelled? Is there a way for us to rescind our signature?

As you stated correctly, the transaction in Docusign is completed, which is a final status that cannot be changed in Docusign eSignature. You cannot void it or rescind your signature in the system, as the transaction was completed and a legally binding contract has been made. However, if there is no signature from the landlord, then no valid contract with him was put into place.

In your situation I would document something in writing to the landlord outside of Docusign that no agreement was made.
